In a news release, Eli Lilly said, "This matter is finally under review and the pharmaceutical company is not taking any actions to protect its brand name from any potential product liability."
Lilly had $20 billion in cash on hand, according to the release, but said that it would be filing a patent infringement suit against the company. The company would have to pay "several million dollars" in costs and potential losses.
"In addition to the cash payment, the company is also filing suit against the pharmaceutical company and other parties for the full amount of cash it will receive in exchange for the drugs," the release said. "A settlement is in the works and the case will go to trial in a few weeks."
The company said that the lawsuit was not filed until June 17.
The release also said Lilly is "reviewing the details of the suit, including the potential for product liability liability, and will file a motion to dismiss the action."
"This matter is now under review and the company is not taking any actions to protect its brand name from any potential product liability," Lilly said in the release.
